Welcome to "On Your Trip". These Terms of Service ("Terms") govern your access to and use of the On Your Trip mobile application and website onytrip.com (collectively, the "Service").
By accessing or using On Your Trip, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
Please read these Terms carefully before using our Service.
1. Acceptance of Terms
By creating an account, accessing, or using On Your Trip, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy.
These Terms constitute a legally binding agreement between you and On Your Trip. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 13 years old (or the applicable age of digital consent in your country) to use our Service. By using On Your Trip, you represent and warrant that you meet this age requirement.
2. Description of Service
On Your Trip is a travel planning platform that provides:
- Destination Discovery: Browse and search thousands of cities and destinations worldwide with detailed information, photos, and user reviews to help you choose your next adventure.
- Personalized Itinerary Creation: Generate customized day-by-day trip plans based on your preferences, budget, travel style, and interests. Edit and customize itineraries to match your exact needs.
- Attraction Database: Access comprehensive information about attractions, restaurants, activities, and experiences including opening hours, pricing, location details, and community ratings.
- Trip Planning Tools: Set travel dates, manage budgets, track expenses, create packing lists, organize daily schedules, and collaborate with travel companions on shared trips.
- Community Reviews: Read authentic reviews from fellow travelers and contribute your own experiences to help others make informed travel decisions.
- Document Organization: Upload and store trip-related documents, booking confirmations, tickets, and inspiration photos in one convenient location accessible from any device.
- Social Collaboration: Share trip plans with friends and family, invite travel companions to co-plan itineraries, and discover where your connections have traveled.
Service Availability Disclaimer: We reserve the absolute right to modify, suspend, temporarily discontinue, or permanently shut down any aspect of On Your Trip at any time, for any reason, with or without advance notice to users. This includes but is not limited to: adding or removing features, changing functionality, imposing usage limits, restricting access to certain regions or user groups, or terminating the entire Service. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, including any resulting loss of data, loss of access to trip plans, or inability to complete travel arrangements. You acknowledge that On Your Trip is provided as a convenience and planning tool only, and you should maintain independent copies of critical travel information.
3. User Accounts and Registration
3.1 Account Creation
To access full features of On Your Trip including saving trips, writing reviews, and syncing across devices, you must create an account. Account creation requires a valid email address and password. By creating an account, you agree to:
- Provide Accurate Information: You must provide truthful, current, and complete information during registration. Providing false information, including false names or email addresses, violates these Terms and may result in immediate account termination without refund or recourse.
- Keep Information Updated: You must promptly update your account information if it changes, particularly your email address, as this is our primary means of communicating with you about your account and travel plans.
- Maintain Account Security: You are responsible for choosing a strong password and keeping it confidential. Do not share your password with anyone. Use unique passwords for each online service you use.
- Accept Full Responsibility: You are legally responsible for ALL activities that occur under your account, whether authorized by you or not. This includes actions taken by anyone you've shared your password with, anyone who accesses your unlocked device, or anyone who gains access through your negligence.
- Immediate Notification Requirement: You must notify us immediately at support@onytrip.com if you suspect unauthorized access, password compromise, or any security breach. Delayed notification may result in your liability for unauthorized activities and waiver of any claims against us.
3.2 Guest Mode
You may explore On Your Trip and create basic trip plans without an account (Guest Mode). Guest Mode limitations include:
- Data stored only on your device (not backed up to our servers)
- No access from other devices
- Automatic deletion after 7 days
- Limited features (no reviews, no trip sharing, no personalized recommendations)
- No recovery if you uninstall the app or clear device data
We are not responsible for any loss of Guest Mode data. Guest Mode is provided as a trial feature only. Create an account to ensure your trip plans are preserved.
3.3 Account Security - Your Sole Responsibility
Critical Security Notice: You are solely and entirely responsible for maintaining the confidentiality and security of your account credentials. You acknowledge and agree that:
- We will NEVER ask for your password via email, phone, or any communication method
- You must log out from shared or public computers after using On Your Trip
- We are NOT liable for any loss, damage, or unauthorized access resulting from your failure to protect your credentials
- Any actions taken using your account credentials will be deemed authorized by you
- We may suspend or terminate accounts showing suspicious activity without prior notice
If you become aware of any unauthorized use of your account, you must immediately change your password and notify us at support@onytrip.com. We will investigate but cannot guarantee recovery of compromised data or reversal of unauthorized actions. We recommend enabling two-factor authentication for additional security.
4. Google Sign-In Authentication
On Your Trip offers Google Sign-In as an authentication option. By choosing to sign in with Google, you agree to the following terms and conditions specific to this authentication method:
4.1 Authorization and Consent
When you select "Sign in with Google," you explicitly authorize On Your Trip to:
- Access Basic Profile Information: Retrieve your Google Account ID, email address, display name, and profile photo (if available) to create and manage your On Your Trip account.
- Verify Your Identity: Use Google's OAuth 2.0 authentication service to securely verify your identity without accessing your Google password or other Google account credentials.
- Link Your Accounts: Create a permanent association between your Google account and your On Your Trip account for authentication purposes.
- Store Authentication Information: Maintain necessary authentication tokens and account identifiers to keep you signed in and enable single sign-on functionality.
4.2 Google's Terms and Policies
Your use of Google Sign-In is governed by both these Terms of Service and Google's own terms and policies:
- Google Terms of Service: You must comply with Google's Terms of Service when using your Google account to authenticate with On Your Trip. Any violation of Google's terms may affect your ability to use Google Sign-In with our Service.
- Google Privacy Policy: Google's handling of your information during the authentication process is governed by Google's Privacy Policy. We encourage you to review Google's Privacy Policy to understand how Google processes your data.
- Third-Party Service: Google Sign-In is a service provided by Google LLC. We are not responsible for Google's authentication service, its availability, reliability, or any issues arising from your Google account.
4.3 Account Linking and Existing Accounts
Special provisions apply when using Google Sign-In with existing accounts or when switching authentication methods:
- Email Address Matching: If you sign in with Google using an email address already associated with an existing On Your Trip account created via email/password, you must first sign in using your original method and then link your Google account through account settings. We will not automatically merge accounts without your explicit action.
- Account Uniqueness: Each Google account can only be linked to one On Your Trip account. You cannot use the same Google account to create multiple On Your Trip accounts. Attempts to circumvent this restriction may result in account suspension.
- Guest Data Migration: If you previously used On Your Trip in Guest Mode and then sign in with Google, any saved guest trip data on your device may be automatically migrated to your new account. This migration is provided as a convenience and is subject to technical limitations. We are not liable for any data that fails to migrate or is lost during the migration process.
4.4 Disconnecting Google Sign-In
You maintain the right to disconnect your Google account from On Your Trip at any time:
- Revocation Process: You may revoke On Your Trip's access to your Google account through your Google Account settings at myaccount.google.com/permissions. Revoking access will immediately terminate Google Sign-In functionality but will NOT automatically delete your On Your Trip account.
- Alternative Authentication Required: After disconnecting Google Sign-In, you must establish an alternative authentication method (email/password) to continue accessing your account. Failure to set up alternative authentication before revoking Google access may result in inability to access your account and potential data loss.
- Account Recovery Limitations: If you revoke Google access without setting up password authentication, we may not be able to verify your identity for account recovery purposes. You agree that On Your Trip is not liable for any inability to access your account resulting from your revocation of Google Sign-In without establishing alternative credentials.
4.5 Security and Responsibility
CRITICAL SECURITY NOTICE: When using Google Sign-In, the security of your On Your Trip account is directly tied to the security of your Google account. You acknowledge and agree that:
- Google Account Security is Your Responsibility: You are solely responsible for maintaining the security of your Google account, including choosing a strong password, enabling two-factor authentication, and protecting against unauthorized access. Any compromise of your Google account may result in unauthorized access to your On Your Trip account.
- Authorized Access Assumption: We will treat any access to your On Your Trip account via Google Sign-In as authorized by you. You agree that we have no obligation to verify the actual identity of the person accessing your account through valid Google authentication credentials.
- Limitation of Liability: On Your Trip is NOT responsible or liable for any unauthorized access, data loss, or damages resulting from: (a) compromise of your Google account credentials, (b) your failure to maintain adequate Google account security, (c) Google's authentication service failures or interruptions, or (d) any security vulnerabilities in Google's systems or services.
- Immediate Notification Required: If you suspect your Google account has been compromised or that someone has gained unauthorized access to your On Your Trip account via Google Sign-In, you must immediately: (1) secure your Google account and change your Google password, (2) revoke On Your Trip's access through Google Account settings, and (3) notify us at support@onytrip.com. Delayed notification may limit our ability to prevent unauthorized activities and may affect your claims.
4.6 Service Availability and Changes
We reserve the right to modify, suspend, or discontinue Google Sign-In functionality at any time, with or without notice, for any reason including but not limited to: technical difficulties, changes to Google's authentication services, security concerns, or business decisions. If we discontinue Google Sign-In, we will provide reasonable notice and opportunity for you to establish alternative authentication methods. However, we are not liable for any inconvenience, data loss, or inability to access your account resulting from discontinuation of Google Sign-In, and your sole remedy would be to use alternative authentication methods we provide.
5. User Conduct and Responsibilities
When using On Your Trip, you agree to abide by the following conduct standards and accept full responsibility for your actions on the platform:
5.1 Legal Compliance
- Comply with All Laws: Use the Service in strict compliance with all applicable local, state, national, and international laws and regulations. This includes but is not limited to data protection laws, consumer protection laws, export control regulations, and anti-spam legislation in your jurisdiction and the jurisdictions where you use the Service.
- Age Requirements: If you are under 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the involvement, supervision, and approval of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
- Restricted Jurisdictions: You may not use the Service if you are located in, or a resident of, any jurisdiction where use of the Service would be illegal or prohibited. You are solely responsible for ensuring your use complies with local laws.
5.2 Respectful Behavior
- Respect Other Users: Treat all users with dignity and respect. Do not engage in harassment, bullying, threatening behavior, hate speech, discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Honest Reviews: Provide truthful, accurate, and unbiased information in all reviews and ratings. Do not post fake reviews, reviews for places you have not visited, reviews in exchange for compensation (unless disclosed), or reviews intended to manipulate ratings or harm competitors.
- Constructive Feedback: Keep reviews constructive and relevant to the attraction or service being reviewed. Avoid profanity, personal attacks, irrelevant commentary, or content that does not relate to the travel experience itself.
5.3 Intellectual Property Respect
- Respect Copyright: Do not upload, post, or share content that infringes upon the copyrights, trademarks, patents, or other intellectual property rights of any third party. Only upload photos, text, or other materials that you own or have explicit permission to use.
- Attribution: If you use third-party content with permission, provide proper attribution and comply with any licensing requirements. Do not claim others' work as your own.
- DMCA Compliance: We respond to valid copyright infringement notices. If you believe your copyright has been infringed, see Section 11 (Copyright Policy) for our takedown procedure.
5.4 System Integrity and Security
- No Interference: Do not interfere with, disrupt, or impose an unreasonable burden on the Service, our servers, networks, or infrastructure. This includes denial-of-service attacks, overwhelming our systems with requests, or any activity that degrades performance for other users.
- No Unauthorized Access: Do not attempt to gain unauthorized access to any part of the Service, other user accounts, computer systems, or networks connected to the Service through hacking, password mining, brute force attacks, or any other means.
- No Malicious Code: Do not transmit, upload, or introduce any viruses, Trojan horses, worms, logic bombs, malware, ransomware, spyware, or other malicious or technologically harmful material that could damage, interfere with, or compromise the Service or users' devices.
- Security Vulnerabilities: If you discover any security vulnerability or flaw in the Service, report it to us immediately at security@onytrip.com rather than exploiting it. Do not disclose security issues publicly until we have had reasonable time to address them.
5.5 Prohibited Activities
- No Illegal Purposes: Do not use the Service for any illegal, fraudulent, or unauthorized purpose, including but not limited to money laundering, terrorist financing, fraud, identity theft, or planning illegal activities.
- No Impersonation: Do not impersonate any person or entity, falsely claim an affiliation with any person or entity, or misrepresent your identity or the source of any content you submit.
- No Data Harvesting: Do not use automated means (bots, scrapers, crawlers, spiders) to access, collect, or harvest data from the Service without our express written permission. Do not collect or store personal information about other users without their consent.
- No Spam: Do not transmit unsolicited or unauthorized advertising, promotional materials, spam, chain letters, pyramid schemes, or any other form of solicitation through the Service.
Violation Consequences: We reserve the right to investigate any suspected violations of these conduct requirements. If we determine you have violated these Terms, we may take action including but not limited to: issuing warnings, removing content, suspending features, temporarily or permanently terminating your account, reporting illegal activity to law enforcement, and pursuing legal action for damages. You agree to cooperate with any such investigation and acknowledge that we have no liability for actions taken in good faith to enforce these Terms.
6. User Content
6.1 Your Content Ownership
You may submit, upload, or post various types of content to On Your Trip, including but not limited to:
- Trip Itineraries: Your planned travel schedules, destinations, dates, and trip details
- Reviews and Ratings: Written reviews, star ratings, and feedback about attractions, restaurants, hotels, and destinations
- Photos and Images: Travel photographs, attraction images, food photos, and other visual content
- Notes and Comments: Personal travel notes, tips, recommendations, and observations
- Profile Information: Your bio, profile picture, travel preferences, and account customizations
All such content is collectively referred to as "User Content." You retain full ownership of all intellectual property rights in your User Content. We do not claim any ownership over your original content.
6.2 License Grant - What We Can Do With Your Content
By submitting User Content to On Your Trip, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit your User Content in connection with operating and providing the Service. This license includes the right to:
- Display Your Content: Show your reviews, ratings, photos, and trip itineraries to other users of the Service to help them plan their travels and make informed decisions about destinations and attractions.
- Use in Marketing: Feature your User Content (such as exceptional photos or positive reviews) in our marketing materials, social media posts, promotional campaigns, website showcases, and advertising to demonstrate the quality and value of our Service. We will make reasonable efforts to credit you when using your content in marketing materials.
- Aggregate and Analyze: Combine your ratings and reviews with those of other users to generate aggregate statistics, popularity rankings, recommendation algorithms, and data analytics that improve the Service for all users.
- Modify for Technical Requirements: Resize, compress, or reformat your photos and content as necessary for display on different devices (mobile phones, tablets, computers), optimize loading speeds, ensure compatibility across platforms, and maintain Service performance.
- Store and Backup: Store copies of your User Content on our servers and backup systems to ensure reliability, prevent data loss, enable service continuity, and provide you with access to your content across all your devices.
- Sublicense: Grant sublicenses to our service providers, partners, and contractors who help us operate the Service, including cloud hosting providers, content delivery networks, analytics services, and technical support partners. All sublicensees are required to maintain confidentiality and use your content only for providing services to us.
This license continues even if you stop using On Your Trip for content that has been shared with other users or incorporated into the Service (such as reviews or ratings), but terminates for private content (such as unpublished trip plans) when you delete your account.
Important Note: This license is necessary for us to provide the Service to you and other users. Without it, we couldn't display your reviews to help other travelers, show your photos across different devices, or include your ratings in our recommendation system. You can manage the visibility of your content through your privacy settings.
6.3 Content Responsibility and Representations
You are solely and entirely responsible for all User Content you submit. By uploading or posting User Content, you explicitly represent, warrant, and covenant that:
- Ownership or Rights: You either own all rights to your User Content or have obtained all necessary licenses, permissions, consents, and authorizations from the rightful owners to submit the content and grant us the license described in Section 5.2. For photos featuring other people, you have obtained their consent to publish their image.
- No Third-Party Infringement: Your User Content does not and will not infringe, violate, or misappropriate any third party's copyright, trademark, patent, trade secret, moral rights, rights of publicity, privacy rights, or any other intellectual property or proprietary rights.
- Accuracy and Truthfulness: All factual information in your User Content, especially in reviews and ratings, is accurate, truthful, and based on your actual personal experience. You have not been compensated or incentivized by any business to provide a positive or negative review (unless clearly disclosed in the review itself).
- No Illegal or Harmful Content: Your User Content does not contain, promote, or facilitate any illegal activity, hate speech, violence, harassment, discrimination, pornography, child exploitation, defamation, invasion of privacy, malicious code, or any other harmful, offensive, or objectionable material as determined under applicable law or community standards.
- Compliance with Laws: Your User Content complies with all applicable local, state, national, and international laws, regulations, and these Terms of Service. This includes but is not limited to laws regarding defamation, privacy, intellectual property, consumer protection, and prohibited content.
- No Confidential Information: Your User Content does not disclose any confidential or proprietary information belonging to others, trade secrets, non-public financial information, or any information you are obligated to keep confidential under contract, law, or fiduciary duty.
6.4 Content Moderation and Removal Rights
We take content quality and user safety seriously, but we are not obligated to pre-screen or continuously monitor all User Content. However, we reserve the following rights:
- Right to Monitor: We may (but have no obligation to) monitor, review, screen, and analyze User Content at any time, using both automated systems and human moderators, to ensure compliance with these Terms and maintain Service quality.
- Right to Remove: We reserve the absolute right to remove, edit, refuse to post, or disable access to any User Content at any time, for any reason or no reason, without prior notice, liability, or obligation to you. This includes content that violates these Terms, receives user complaints, appears fraudulent or suspicious, or that we deem inappropriate, offensive, harmful, or inconsistent with our community values.
- Right to Edit: In limited circumstances, we may edit User Content to correct obvious errors, remove prohibited content while preserving the remainder, redact personal information inadvertently disclosed, or format content for proper display. We will not alter the substantive meaning of reviews or ratings.
- No Pre-Publication Review: Unless otherwise indicated, we do not review User Content before it is posted. The appearance of User Content on the Service does not constitute our endorsement, verification, or approval of such content.
- User Reporting: We encourage users to report inappropriate, offensive, fraudulent, or policy-violating content using our reporting features. We will investigate reports and take appropriate action, which may include content removal, user warnings, or account suspension.
No Liability for User Content: We are not responsible or liable for any User Content, including its accuracy, quality, legality, or reliability. We do not endorse any opinions expressed in User Content. Any reliance you place on User Content is strictly at your own risk. We are not liable for any loss, damage, harm, or injury resulting from User Content, whether posted by you or others.
6.5 Prohibited Content Types
The following types of content are strictly prohibited and will result in immediate removal and possible account termination:
- Content that infringes intellectual property rights (copyrighted text, photos, trademarked materials)
- Fake, misleading, or fraudulent reviews not based on actual personal experience
- Reviews submitted in exchange for compensation without clear disclosure
- Spam, advertisements, or promotional content disguised as reviews
- Hate speech, discriminatory content, or harassment targeting individuals or groups
- Sexually explicit, pornographic, or obscene content
- Content depicting or promoting violence, self-harm, or dangerous activities
- Personal information of others (phone numbers, addresses, financial info) shared without consent
- Malicious code, viruses, or content designed to harm systems or users
- Content that violates any applicable law or regulation
7. Intellectual Property Rights
7.1 Our Proprietary Rights
The Service and all of its original content (excluding User Content), features, design, functionality, software code, algorithms, user interface, graphics, logos, text, and other materials are owned exclusively by On Your Tripor our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
- Copyrights: All textual content, graphics, user interfaces, visual interfaces, photographs, videos, illustrations, designs, icons, and computer code included in the Service are copyrighted works owned by or licensed to On Your Trip. Unauthorized reproduction, distribution, modification, or public display of these copyrighted works is strictly prohibited and may subject you to civil and criminal penalties.
- Trademarks: "On Your Trip," our logo, our tagline, and any other product or service names, logos, or slogans displayed on the Service are registered or unregistered trademarks of On Your Trip or third parties. You may not use these trademarks without our prior written permission or that of the third-party owner. Use of our trademarks in connection with any product or service that is not ours may constitute trademark infringement and unfair competition.
- Trade Secrets and Proprietary Information: The Service contains proprietary and confidential information including but not limited to our recommendation algorithms, data processing methods, business processes, user analytics systems, and technical specifications. This information is protected as trade secrets and you agree not to disclose, use, or attempt to discover such proprietary information.
- Database Rights: Our compilation of destinations, attractions, reviews, ratings, and other data constitutes a valuable database protected by copyright and database rights. Systematic extraction, re-utilization, or reproduction of substantial parts of our database is prohibited without authorization.
7.2 Limited License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and use the Service solely for your personal, non-commercial travel planning purposes
- Download and view content from the Service on your personal devices
- Print individual pages from the Service for your personal trip planning use
This license does not include any right to: (a) resell, commercially exploit, or distribute the Service or its content; (b) modify, reverse engineer, decompile, or create derivative works based on the Service; (c) download (other than page caching) or copy any content for purposes other than personal use; (d) use any data mining, robots, or similar automated data gathering or extraction methods; or (e) use the Service in any manner that could damage, disable, overburden, or impair our servers or networks.
7.3 Restrictions on Use
You expressly agree NOT to:
- Copy or Reproduce: Copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Service in any form or by any means, except as expressly permitted in Section 6.2 above.
- Modify or Create Derivatives: Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Service, its software, or any content therein, except as required by law or as expressly authorized by us in writing.
- Commercial Use: Use the Service or its content for any commercial purpose or for the benefit of any third party, including but not limited to selling access to the Service, using the Service to operate a competing service, or incorporating Service content into commercial products, without our express written authorization.
- Remove Notices: Remove, obscure, or alter any copyright notices, trademarks, or other proprietary rights notices displayed on or through the Service.
- Circumvent Protection: Circumvent, disable, or otherwise interfere with security-related features or features that prevent or restrict use, copying, or access to any content or the Service.
7.4 Feedback and Suggestions
If you provide us with any feedback, suggestions, ideas, enhancement requests, recommendations, or other input regarding the Service ("Feedback"), you hereby assign to On Your Trip all rights, title, and interest in such Feedback and agree that we may use this Feedback for any purpose without restriction or compensation to you. We are under no obligation to implement, acknowledge, or compensate you for any Feedback you provide.
Intellectual Property Violation Consequences: Violation of these intellectual property provisions may result in immediate termination of your account and access to the Service. We reserve the right to pursue all available legal remedies, including but not limited to injunctive relief, monetary damages, attorney's fees, and criminal prosecution for intellectual property theft. You agree to indemnify us for any losses resulting from your intellectual property violations.
8. Prohibited Uses
In addition to the conduct restrictions in Section 4, you explicitly agree NOT to use On Your Trip for any of the following prohibited purposes. Violation of these prohibitions may result in immediate account termination, legal action, and liability for damages:
8.1 Legal and Regulatory Violations
- Violating Laws: Using the Service in any manner that violates any applicable local, state, provincial, national, or international law, regulation, ordinance, directive, treaty, or governmental order, including but not limited to laws concerning data protection, privacy, export control, consumer protection, unfair competition, anti-discrimination, false advertising, or telecommunications.
- Illegal Transactions: Using the Service to facilitate, promote, or engage in any illegal transaction, including money laundering, terrorist financing, drug trafficking, human trafficking, fraud, embezzlement, tax evasion, or any other criminal activity.
- Sanctions Violations: Using the Service if you are located in, or a resident of, any country or region subject to U.S. sanctions or embargoes, or if you are listed on any U.S. government list of prohibited or restricted parties.
8.2 Intellectual Property Violations
- Copyright Infringement: Uploading, posting, transmitting, or otherwise making available any content that infringes any copyright, trademark, patent, trade secret, or other proprietary or intellectual property rights of any person or entity, including using copyrighted photos, text, logos, or other materials without proper authorization or license.
- Counterfeit or Pirated Materials: Distributing, promoting, or linking to counterfeit goods, pirated software, unauthorized copies of copyrighted works, circumvention tools, or license key generators.

- Harassment and Abuse: Harassing, threatening, intimidating, stalking, bullying, abusing, or otherwise causing distress, alarm, or annoyance to any other user, person, or entity.
- Hate Speech and Discrimination: Posting content that promotes hatred, violence, discrimination, or intolerance against individuals or groups based on race, ethnicity, religion, national origin, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
- Violent or Disturbing Content: Uploading or sharing content that depicts, glorifies, or promotes violence, gore, self-harm, suicide, animal cruelty, torture, or any other graphic, disturbing, or excessively violent material.
- Sexual Exploitation: Posting sexually explicit, pornographic, or obscene content, or any content that exploits, sexualizes, or endangers minors in any way.
8.4 Fraudulent and Deceptive Practices
- False Information: Submitting, posting, or transmitting false, misleading, fraudulent, deceptive, or inaccurate information, including fake reviews, manipulated ratings, false trip reports, or misrepresentations about destinations, attractions, or services.
- Impersonation: Impersonating any person or entity (including other users, celebrities, government officials, or company representatives), falsely stating or implying affiliation with any person or entity, or misrepresenting your identity, credentials, or the source of any content.
- Review Manipulation: Engaging in any activity designed to manipulate, inflate, deflate, or distort ratings or reviews, including posting multiple reviews under different accounts, paying for positive reviews, coercing users to leave favorable reviews, or posting negative reviews of competitors.
- Phishing and Social Engineering: Attempting to obtain sensitive information (passwords, financial data, personal information) from other users through deception, phishing, pretexting, or other social engineering techniques.
8.5 Privacy Violations and Data Misuse
- Unauthorized Data Collection: Collecting, harvesting, scraping, or storing personal information, email addresses, usernames, or other data about users without their explicit consent or our authorization.
- Privacy Invasion: Disclosing private or confidential information about other users, posting photos of others without their consent, doxxing (publishing private identifying information), or otherwise invading the privacy of individuals.
- Tracking and Surveillance: Using the Service to track, monitor, stalk, or surveil other users or third parties without their knowledge and consent.
8.6 Spam and Unsolicited Communications
- Spam: Transmitting, distributing, or posting unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized solicitation.
- Commercial Solicitation: Using the Service to send commercial messages, advertisements, or promotional content to other users without their prior consent, or in violation of applicable anti-spam laws (CAN-SPAM, GDPR, etc.).
- Mass Messaging: Sending bulk, mass, or automated messages to multiple users for any purpose, whether commercial or non-commercial, without authorization.

- Hacking and Unauthorized Access: Attempting to gain unauthorized access to the Service, other user accounts, our computer systems, servers, networks, or any data, through hacking, password mining, brute force attacks, or any other means.
- Security Interference: Interfering with, disabling, circumventing, or bypassing any security features, authentication measures, access controls, encryption, digital rights management, or other protective measures of the Service.
- Malicious Code: Uploading, transmitting, or introducing any viruses, Trojan horses, worms, logic bombs, ransomware, spyware, malware, or other malicious or technologically harmful code, programs, or files that could damage, interfere with, intercept, or expropriate any system, data, or information.
- Denial of Service: Engaging in any activity that disrupts, interferes with, or imposes an unreasonable or disproportionately large load on the Service infrastructure, including denial-of-service attacks, distributed denial-of-service attacks, flooding, mail-bombing, or crashing.

- Commercial Exploitation: Using the Service or any of its content, features, or data for any commercial purpose or for the benefit of any third party without our express written authorization, including reselling access, operating travel agencies, providing paid consultation services, or monetizing Service content.
- Framing and Linking: Framing, mirroring, or creating inline links to any part of the Service without our prior written consent, or representing that the Service or its content is associated with, endorsed by, or originated by any third party.
- Affiliate Abuse: Using the Service to generate fraudulent referrals, clicks, or conversions for affiliate programs, or manipulating affiliate links or tracking mechanisms.
ENFORCEMENT AND CONSEQUENCES: Violation of any prohibited use described in this Section 7 constitutes a material breach of these Terms and may result in immediate consequences including: (a) immediate termination of your account and access to the Service without notice or refund; (b) removal of all your User Content; (c) legal action to enforce our rights and seek remedies, including injunctive relief and monetary damages; (d) reporting to law enforcement authorities when illegal activity is suspected; (e) cooperation with legal authorities in any investigation or prosecution; and (f) pursuit of all available civil and criminal remedies. We reserve the right to investigate suspected violations using all available means and to take any action we deem appropriate in our sole discretion. You agree to fully cooperate with any such investigation and accept sole responsibility and liability for your prohibited activities, including all legal fees, damages, and costs we incur as a result of your violations.

9.1 Service Provided "AS IS" and "AS AVAILABLE"
CRITICAL DISCLAIMER: On Your Trip is provided strictly "AS IS" and "AS AVAILABLE" basis WITHOUT WARRANTIES OF ANY KIND, either express, implied, statutory, or otherwise. We explicitly disclaim ALL warranties including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the quality, accuracy, or reliability of information obtained through the Service
- Any warranty that defects will be corrected or that the Service is free of viruses or harmful components
- Any warranties arising from course of dealing or usage of trade
No advice or information, whether oral or written, obtained by you from On Your Trip or through the Service shall create any warranty not expressly stated herein. You use the Service entirely at your own risk.
9.2 Travel Information - Informational Purposes Only
NO GUARANTEE OF ACCURACY: All travel recommendations, itineraries, attraction information, reviews, ratings, prices, hours of operation, and other content provided by On Your Trip are for informational and planning purposes ONLY. We make NO guarantees, representations, or warranties regarding the accuracy, completeness, timeliness, or reliability of ANY travel information.
- Verify All Information: You must independently verify ALL information before making travel decisions, bookings, or commitments. Information may be outdated, incorrect, or change without notice. Attractions may close, change hours, increase prices, or cease operations without our knowledge.
- Travel Advisories: You are solely responsible for checking current government travel advisories, health warnings, visa requirements, passport validity, vaccination requirements, and any travel restrictions for your destinations. We do not monitor or provide updates on changing travel regulations.
- Travel Documents: Ensure you have all necessary travel documents including valid passports, visas, travel permits, health certificates, and any other required documentation. We are not responsible if you are denied entry, refused boarding, or encounter legal issues due to inadequate documentation.
- Travel Insurance: We STRONGLY recommend purchasing comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, lost luggage, and other travel-related risks. We do not provide insurance and are not liable for any losses that insurance would have covered.

- The content, accuracy, availability, or quality of third-party websites or services
- The privacy practices or data collection policies of third parties
- The terms and conditions, pricing, or cancellation policies of third-party providers
- Any transactions, bookings, or contracts between you and third parties
- Any disputes, damages, or losses arising from your dealings with third parties
- The operations, safety standards, or business practices of attractions, hotels, restaurants, or tour operators
Links to third-party sites do not constitute endorsement. Your interactions with any third party are governed solely by your agreement with that third party. We are not a party to such transactions and disclaim all liability.
9.4 User-Generated Content - No Endorsement or Verification
User reviews, ratings, photos, comments, and trip reports reflect individual opinions and personal experiences only. We do NOT:
- Endorse, verify, confirm, or guarantee the accuracy of any user-generated content
- Confirm that reviewers actually visited the locations they review
- Verify the authenticity of photos or validate claims made in reviews
- Investigate or fact-check user submissions (except for obvious spam or abuse)
- Accept responsibility for misleading, fraudulent, or inaccurate user content
Reviews should NOT be your sole basis for travel decisions. Individual experiences vary significantly based on timing, expectations, personal preferences, and circumstances. Use reviews as ONE data point among many when planning.
9.5 LIMITATION OF LIABILITY - MAXIMUM LEGAL EXTENT
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- No Liability for Damages: On Your Trip, its officers, directors, employees, agents, licensors, and service providers SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to: loss of profits, loss of revenue, loss of data, loss of business opportunities, loss of goodwill, personal injury, property damage, emotional distress, or any other intangible losses.
- Travel-Related Losses: We are NOT liable for any losses resulting from your travel decisions, including: missed flights, cancelled reservations, denied entry, lost luggage, theft, accidents, injuries, illness, natural disasters, political unrest, terrorism, or any other travel-related incidents or inconveniences.
- Service Interruptions: We are NOT liable for any damage or loss resulting from: (a) your inability to access or use the Service, (b) interruptions or delays in the Service, (c) bugs, viruses, or harmful code transmitted through the Service, (d) errors, inaccuracies, or omissions in content, or (e) loss or corruption of data.
- Maximum Liability Cap: In no event shall our total aggregate liability for all claims related to the Service exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) ONE HUNDRED DOLLARS ($100 USD). This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another user or third party
- Your User Content
- Your travel decisions or activities
11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us at support@onytrip.com or through the app settings.
11.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for any reason, including:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended period of inactivity
- At your request
- Technical or security reasons
11.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content. Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
12. Modifications to Service and Terms
12.1 Service Changes
We reserve the right to modify, suspend, or discontinue any aspect of On Your Trip at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service.
12.2 Terms Changes
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of these Terms
- Notify you through the app or via email
- Provide a prominent notice for significant changes
Your continued use of On Your Trip after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which On Your Trip operates, without regard to its conflict of law provisions. Your use of the Service may also be subject to other local, state, national, or international laws.
14. Dispute Resolution
14.1 Informal Resolution
If you have any dispute with us, you agree to first contact us at support@onytrip.com and attempt to resolve the dispute informally. We will work with you in good faith to resolve any issues.
14.2 Binding Arbitration
If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association. The arbitration shall take place in the jurisdiction where On Your Trip operates.
Additional Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and On Your Trip regarding the Service and supersede all prior agreements and understandings.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision must be in writing and signed by us.
Assignment
You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.
Acknowledgment
By using On Your Trip, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that you have read and understood our Privacy Policy.
